It uses dual 3D camera (which kinect did NOT have, it had one standard and one infrared lens, but they did not see in stereoscopic 3D. The kinect comparisons come from 3D motion tracking, which until now was something not available on PlayStation (not full body, at least). Now we have it.

Not sure where you got that info. Wii U's GPU still gets smoked by both "Durango" and "Orbis". According to the leaks Durango's GPU is a bit weaker than PS4/Orbis... lacking 2 shader cores and 4 compute cores if I remember right (I think Durango has 12 and orbis 18). Maybe even a slower clock speed as well, but I don't remember the specifics.

PS3 continues to outsell worldwide and already has outshipped 360, so I wouldn't say "second gen and MS are on top", when such a statement is only localized to 2 markets vs. the entire globe.
You don't even have to wait that long, EA already said it isn't targeting Wii U with it's next gen plans due to it's lack of power.

As for the Sony patent, they also had a similar patent when PS3 launched that never saw the light of day. Patents mean nothing.
