I mean it's obvious that today, Xbox studios are using UE4/5 given the games we've already seen come out or be announced (e.g. Gears of War & Hellblade).
But it also makes business sense that if they own idTech, they should try and leverage that because licensing UE is expensive and they're giving away revenue to Epic while owning an equivalent engine of their own.
My guess here is rather than outright saying "they are exclusive", MS hid it behind the "only on GamePass platforms" wording to look better and be able to say "not our fault, Sony/Nintendo won't let us bring GamePass to their platform".
There's really no loss in wording it that way - either MS gets to blame the other companies, or the other companies cave and allow GamePass.
I believe current obligations refers to signed exclusivity contracts (e.g. Death Loop & GhostWire). Typically if a game is coming to a platform, but with no exclusivity, no contract has been signed between the platform holder & the developer/publisher beyond that of being a registered developer for the platform.

@Deep_Space_One I wouldn't say most people are cheering it on - personally, I think exclusivity all-up is bad because:
1. I don't need to justify/self-validate my purchase of a game console that way, there's plenty of good content from 3rd parties.
2. It just means people miss out on good IP's - not everyone can afford to buy all 3 consoles + a gaming PC
