Digital downloads are fine and great when done right (i.e. Steam) but more often than not, it's an excuse to penny pinch the consumer. With a purely digital title that only has one seller on a platform (i.e PSN or XBL), the price doesn't need to come down because there's no competition. As with everyone else, I'm skeptical about the review score due to the circumstances behind it, but to be perfectly honest Rebellion's track record lately has been pretty awful so I wouldn't be THAT surprised at a score like this.

Bioware (EA) owns the rights to Mass Effect, not Microsoft. They wouldn't be able to port even Mass Effect 2 if they couldn't port Mass Effect 1 to the PS3 due to license agreements.
It doesn't matter who published what originally, Bioware owns the IP and can do what they like with it, they just might need another publisher to put it on the PS3 - but look, since ME1 was released, they're now owned by EA, one of the largest publishers out there, so I doubt that'll be an issue.

Seriously, less say for the sake of argument that the PS3 outsold the 360 (as in total sales) tomorrow - would it change much? There's still 30million+ 360's out there, that's still half of the market so developers would be crazy to ignore it.

Charmers, that's a very one-dimensional view of the situation. Think of it this way - how much money do you think the likes of GTAIV made? All that money has to go somewhere and it would be better for the UK to get that money than if it went to the US or whatever. The UK, as a whole, makes more money than they would from getting just the tax from this one company.

No, hacking just about anything is a great achievement. Sure, you get people hacking consoles to promote piracy and such, but nobody cares about those people. I've said it before and I'll say it again - I'm still firmly on the fence when it comes to Natal. Unlike some people, I can appreciate how incredible the technology is from a purely technical point of view, I can think of at least 15 other appliances around the house that could do with some skeletal recognition built into them - not just games, and of course the potential for gaming is incredible.
