Sell the Wii-U deluxe model for $300 with the games undercutting the cheapest retail prices, new or used, by $10. I may also say to go for $250 or $200 at least for the Wii-U since it isn't selling in stores very well in comparison to any other console, past nintendo consoles included.

For all you know, he may be posting now after just now buying and finishing the game; not all people buy games at release or at their $60 tag. Misleadingly advertising something is in no way, shape, or form the same as false advertising in the way that the law considers it. They disregard claims that are subjective (ie "game is boring, ads weren't") because it is merely opinion...
Assassin's Creed 3 wasn't subject to false advertising because it was still representing the actual product. There is a difference between "this game didn't seem boring in the ads, but it is" and false advertising.

And your comparison is a strawman fallacy; no sane person would be expecting to be hallucinating a tropical paradise popping out everywhere in the city when they open Sierra Mist bottles, but every sane person would expect the demonstration (hence why they call it a "demo") to not only be representative of the product, but be a generally rougher version of the final product.

The point there is that some people will steal, no matter what the cost of the item is. So the developers and producers need to focus on incentives for us not to steal rather than trying to outright punish those who do. The best way is to ensure that $60 we pay is very much worth it.
