the fact, as the law sees it, is that they have no right to prevent the preowned market, once we've bought a copy of a game, it becomes our property, and the publisher then has absolutely no say in what we do with it, so long as we remain within the law.

it's not the passes themselves that are the problem, it's that they're just the opening salvo in the industry's unwarranted, and illegal, war on preowned sales.
once somebody buys a game, they become the owner of that copy, they can then legally transfer ownership of that copy to another person, or a store in many cases, by either selling it or giving it away.
and the publisher has no right whatsoever to prevent that perfectly legal act.
