We in the USA do live in a country that lets us make those choices, but keep in mind that freeedom also extends to an organization or retailer's choice on what they want to sell.
Even in just multiplayer, some avatar called "Taliban" killing some avatar called "US Soldier" sounds like a FAIL product to try to get US military stores to sell. Why would anyone even think they would want to sell that?
It seems like a shallow perspective when the author calls the mother of a slain soldier "self righteous" for being upset at this game. The author goes to great legnths to say these characters are just avatars, and it doesn't matter what uniform they wear. It reminds me of an earlier age. But Duke Nukem seems about as relevent as Rambo these days.
But on the other hand, a really good game is still a really good game. I'd check it out if it gets great reviews.
This may not be a revelation to most people with half a brain here...but people have full time jobs at corporations like these on the technical & legal side dealing with piracy. So why is it pointless for them to do what they are payed to do?
Although I am not interested much in motion controllers, I will pick up Move in the PS3 bundle, because I want to replace my bedroom PS3 that died on me a while ago.

I have never owned an Xbox, but I am glad Microsoft is in the gaming industry. Competition is good. It forces aggressive product development. It's a good thing for gamers to have more than two companies fighting it out for market share.

I don't know where you live, but even here in my "rich country" I did not need a video game to have fun when I was a kid. We made games out of everything. So sorry, I do not feel sorry for any kids that can;t afford a video game. They are probably better off without it.

I hate this term "hardcore" when it comes to gaming, because it really does not describe anything very specific. It is such a general term, and rather meaningless. Besides, there is nothing "hardcore" about chillin' at home, playing a video game. Lazycore might me a better description.
