That is not how patented infringement works, you don't simply get away with it because you are not making money from it. Both RPCS3 and PCSX2 are open source under the GPL license, if there was a patented infringement, you can be sure that they would already be taken down because the code is wide open. And no company would just let it slide.

I mean we are soon to enter a paradigm shift with PCs. Both AMD and Intel are working on some really big improvements in their platforms. So I could see both Sony and Microsoft going for a mid-gen update to take advantage of those on the console market as well.

To be honest that is not even the problem. What people forget about the 3000 series is that it was not that big of a deal performance-wise.
