The emulator hosted does not provide ROMs but a way to execute ROMs. Microsoft is not hosting ROMs either nor is there a way to directly download ROMs to the Xbox One.
It is also 100% possible to backup already owned games as ROMs for execution. Xbox One does not allow you to do so nor this emulator. If people choose to download said ROMs online they are doing so based on their own choice. MS is also no part of these sites hosting ROMs. That comes down to the user and site ...
The same emulators have been around long before Nintendo announced the Mini. Nintendo has long been aware also C&Ding anything they can that doesn't line their pockets.

@fr0sty: Uncharted 4 doesn't even offer 60fps for multiplayer. Killzone Shadow Fall doesn't run at a locked 60. Battlefield titles don't hit 60. All signs point to Gran Turismo Sport not being locked to 60.
There are PLENTY of examples out there of games on PS4 not hitting or being locked to 60fps.

Exclusives won't exist for PS4 PRO as confirmed by Sony. It'll merely upscale PS4 content when possible.
Scorpio on the other hand has been said to potentially have its own games plus play all Xbox One content.

That's the thing. Both Scorpio and Neo are confirmed to play Xbox One and PS4 titles boasting upgrades.
If you don't upgrade you miss out on a few titles that are exclusive just as you will if you don't get into VR.
