First of all because all CPUs support in-order execution - It's the Cell that doesn't support out-of-order execution.
And second, because the 360 CPU is actually based on the Cell (same IBM PowerPC) and shares a fairly similar architecture. the biggest difference is probably that all of it's cores are all-purpose multi-threaded as opposed to the dedicated SPUs on the cell. Unfortunately 3-5 hours means mostly short and unsatisfying games. Most developers will not bother with prolonged and engaging games when they know most people will run out of battery in the middle of playing.
Add to that specs that will be obsolete next year when new mobile phones are released with cortex A15 (this spec is barely on par with current phones like the galaxy 2 and HTC sensarion) and the future doesn't look too good for this machine.

Actually, to find a PS3 exclusive scoring anything higher then 92 metacritic you'll have to travel almost two years back in time to Uncharted 2. So I guess that comparatively "barely breaking 9's" is not all that bad. You need to get a little perspective for how rare 90+ titles are be it on any console or PC.
