Hmm, I didn't notice any jerky aim. I had a problem with enemies not responding to getting hit. Just didn't give the proper sense of feedback to the weapons.

If you want to talk about 'poor comparisons' then the wal-mart comparison is pretty poor as well. The Elite membership isn't charging you to play the game or even play online. It's akin to wal-mart having a new subsection in the store that you can only access by paying a membership.
What would I do? I'd ignore that part of the store whilst respecting their decision.

Latency is always a factor when playing online.
In most cases, it's a geographic factor. The closer you are to the server, the better your latency... and the person living closest to the server will usually have the advantage.
Maybe if they moved all their servers to the center of the earth, things might balance out then.
