The title is ps3 and psp decimate "competition" and the sales numbers include nintendo systems. If it just said xbox I'd understand and agree, but even then it's not news given xbox doesn't sell in Japan and never has.

If the guy you sue is broke you don't get anything. Even if they have money, they can file bankruptcy as a result of the suit and then the plaintiff comes after all existing creditors.
Corporations that big have mighty deep pockets and aren't filing bankruptcy to get out of it.
They probably won't settle until they know the merits of the suit. Even then they'll likely file motions to dismiss and request summary judgment. If the other party survives this then the claim goes way up in price and you're most likely to see a settlement. Even then nintendo might fight it out.
Treble damages are harsh, if they push for those Nintendo isn't settling because it's basically a huge punishment for (allegedly) ripping them off.
About 40% of lawsuits are dismissed on summary judgment before they even start. Some don't even make it that far and are dismissed after filing on a rule 12 motion (failure to state a claim on which relief can be granted, etcetc). It's posted here because this site is filled with viral marketers and obsessed ps3 owners who think everyone cares about Sony (I have a ps3 but when I click on the wii section I want WII NEWS). Two of the top three posts in the wii section are sony will win the marathon and this, which has a picture of a ps3.
