I got one strike on my YouTube account over it and I was pissed. I fought it, but nothing came of it.
For what its worth, they probably didn't have a huge preorder allotment to begin with. Like I remember I wanted a Wii U and they were also sold out. I eventually bought a bundle from NewEgg because I figured it was better than nothing and came with what I wanted, plus an extra game.
