Microsoft doesn't charge for hosting content on Xbox Live though, that's part of what we (the users of Live) pay for. Sony charges these fees to the developer. It's Apples and oranges, but Microsoft focusses on giving devs what they want, while Sony focusses more on the consumer end.

It doesn't need the hardware chip, that's why it's called software emulation. When you play N64 games on your computer, you don't need an N64 chip in your computer. What the software does is "spoof" how your hardware looks/works in relation to how the ROM was designed to be run. Well I agree that some of them want to pirate PS3 games, but who cares? People have wanted software emulation for PS2 titles for a long time. It isn't any stretch of the imagination that this is all they would use it for.
