Why not both? A full blown t-rex walking around the map eating people with the game-fixing patch strapped to it's back. He who kills it gets his game fixed.
Dead Space games are a testament to that. High framerate (like 100+) screws up the physics, bodies start flapping around like they're having a seizure and a jet engine up their butt holes.

While AC4 is an excellent game by any standard, I too believe it needs a combat overhaul. The combat is far too simple and it actually feels disconnected from everything else. It's not as free flowing as in, for example, Batman Arkham games. The animations are pretty bad as well, most of the hits don't even connect and there is no feeling of weight to any move.
It's pretty unsatisfying.
I'm actually disappointed, I expected something bigger than Game of Thrones.
A new Crash Bandicoot, Half Life 3, GTAV PC, New Red Dead.. aaaaaaaand it turned out to be Game of Thrones. One can't help but feel disappointed.

Honestly I'm pleasantly surprised with the game's optimization, especially after the steaming pile of crap Ghost Recon Future Soldier and AC3 were.
AC4 is demanding, yes. But it does run relatively good (since there are some issues on both powerful rigs and low-end rigs and laptops.)
I asked AMD on Twitter about driver optimizations, they said they've already implemented all that was possible.
It runs about the same as FC3.
Actually I have a mid-range GPU that I overclocked quite a bit (HD7850 2GB @ 1100/1375). I don't know how it compares to your 765m, but it seems to me that laptops are having a really hard time playing this game.

I run from 35 - 60fps on a HD7850 without Soft Shadows and the game looks fantastic! Though I wish I had a more stable framerate.. A stable 30 > 30-60 when it comes to games like AC.
If I ever get a PS4 I'll get the game again for it. It's amazing.
