free speech has never been 'free' as in without consequence.
And i doubt there's ever been a time when going into a store and threatening the staff would have led to anything but the police being called.
If it was delivered as a 'figure of speech' then i doubt the staff would have been that bothered.
I imagine it was made in a more threatening manner and as such they more than within their rights to get the police involved - something which is as right now as it would have been twenty, thirty years ago.

To me, the review reads like he started out with a score and tried to write the review to justify it, and failed.
Even in spite of his criticisms the score sits at odds with the tone of the review - which suggests a decent but flawed game.
What struck me as odd about the review was the things he chose to criticise;
1. the story. so far i'm not feeling it as much as U2 but it's still streets ahead of most of the forgettable dross out there.

It's not 'the' developers of Black. It's 'a' developer of Black - Stuart Black, in fact, who even left Codemasters before the game was finished.
'The' developers of Black are still going strong making Burnout and NFS games as Criterion.
It's happened in all GT games, not just 5. People moaned a bit after 1 and 2 but it wasn't as vocal because;
A. sites such as this weren't around for folks to bitch on.
B. the practically identical RUFs meant we weren't really missing anything.

If you pay good money for an exclusive license, then why shouldn't you use it as you see fit and for your own interests first ?

Which is better, having a game a month or so late or not having it at all?
If I heard i wasn't going to have the chance to play something like Limbo just because the platform holder wanted to play silly beggars then.....
