That would make the console business worthless. The result of this court case winning would be it'd be pointless releasing games consoles in the uk in future. It would kill the market.

I don't think it's reluctance per se but they tried to compete with cod and the shooters used to have their multiplayer lobbies die when cod released and if they released too soon- people would buy COD instead of the exclusive fps. Of course if NS made cod exclusive and Sony announced its own military fps ir a title like a new resistance then I think it would do well

COD won't be exclusive until sonys deal for the marketing rights expires I just realised the answer to my own question. The relevance or this is most likely that MS won't be able to out COD games on games pass till they have already been out for a year..... till the 2028 release...

They are never going to produce 5-8 exclusives a year. 3 or 4 if you are lucky becauae todo anything else simply isn't profitable.

@domination actually there is ample evidence that most gamespass games will be nicrotransaction filled and geared towards being games as a service and multiplayer. Why? Well part of it is about profitability the second part is you need people to remain subscribed not subscribe for a month- then unsubscribe and wait for thr next big title theybare interested in and resubscribe. You need to keep them subscribed and spending money.

@fattyboy3D Microsoft have already stated they will honour all existing contracts fully. Just as they have had to with bethesda- releasing a couple of games as times ps5 exclusives... because the agreements were already there.

This is being misrepresented of Sony have marketing rights then they can't put it on games pass. I guarantee you that Microsoft has similar conditions in contracts even they have marketing rights.... also quite what this has todo with anything is beyond me. If MS want to challenge this as an anti-trust matter; then they can but it has 0 impact on if activision acquisition is anticonpetitve or not.

Based on MS's comments about Sony having clauses in contracts blocking games release on games pass where they have marketing rights. MA may actually be contractually unable to release COD on games pass till 1-2 years after each titles release till 20227.

They literally are on record saying in another statement to questions from a market competition authority that when it comes tondeciding what to make exclusive profitability in short term isn't deciding factor. If the title has the powers to draw lots of players to their platform in the longer term to play the game. That is the deciding factor. Do the maths. COD will go exclusive after 2027 when soby'a agreement with activision was due to expire or renew. Unless its mid gen then I bet...

I mean this isn't news? This is simply a pretty standard part of marketing rights contracts. It is obvious this would be the case. This is it exactly. So take resident evil Sony have exclusive promo rights with capcom. As a result the contract says they can't promote or support a rival streaming platform and can until the contract is up only release on ps plus if they so choose.
