Just for reference from Ubisoft financials recently. Retail sales are still 60% or more. Keep in mind digital includes all DLC that retail users still have to get digitally.

The server issues aren't that bad. You think there would have been server issues pre-release when only a 100 reviewers are playing? Not likely. But then you have to ask... how fun would multiplayer be when no one else is playing the game? That is why some of these companies don't allow early reviews.
Tech prices drop a lot in a year. While they certainly couldn't sell that for $400 if released now... it should be feasible in a year.

It doesn't prove that. Come release date they will revoke the access granted by pre-order code.
Otherwise you could pre-order, get the code and play the game for ever... but never pick up your game from Gamestop or wherever.

Publishers can't release on a system without approval, so Sony could mandate requirements like that.
