Yes the Kinect Hack was legal, and no the Playstation hack wasn't. The reasons?
1. The kinect hack was done by writing drivers for it to run on PC, there was no reverse engineering involved.

I find it hard to believe that a supposedly easy to hack console only got hacked after 4 years of trail and error. Either the security was better than what you make it out to be, or the people who did manage to hack it did the smarter thing than Geohotz did - e.g., they kept it for themselves.

Mass Effect 2 didn't look all that impressive to me (Good, but not as good as my PC can handle), Bioshock ran on a heavily modified version of the Unreal Engine, and Gears of War 1 & 2, like Killzone, offer a very limited colour palette.
Unreal Engine 4 should be able to show something that looks significantly better than Killzone 3, and even Crysis 2 and Rage
... But we'll find out next week.
Killzone 3 looks good, but definitely not a generation ahead of what Unreal games look like. What they are going to showcase, is going to look a generation ahead of Killzone 3. Just hope Sony, Microsoft and Nintendo are willing to make that step sooner rather than later.

Bull - They started working on it the moment they released Ps3. Any statements saying otherwise are just marketing (e.g. Please consumers, continue buying Ps3s, as Ps4 won't come anytime soon). Then at E3 2011 they will announce it.

This is only a security flaw for people who use custom firmware. Even though the data isn't encrypted, it runs through encrypted channels, which simply speaking means that hackers cannot get the information unless they install a trojan horse on your ps3. For doing that, your Ps3 needs to have Custom Firmware.
Since custom firmware is illegal as of now, it's a non-issue for legal users.

If Sony sticks with the Cell architecture, than it's unlikely that they'll use the 8 SPU variant. Instead, they will likely opt for a higher number of cores (Last I heard, at IBM research they're already up to 16 or even 32). Additionally, a high-performance GPU is guaranteed, as the Ps4 would need to compete with current desktop GPUs, which are incredibly powerful, even if todays games don't show that just yet.
