No. They only own the film rights. Every other aspect of the character is owned by Marvel.
They're making exclusive games because they currently hold the license. If Marvel chooses not to renew that contract later, they will regain the license and redistribute it to whomever they see fit.

Plus as for playing at Midnight... if you go to Walmart, for example, and ask if you can get a copy, they'll often go in back and grab you one even if it's not on the shelf yet, so long as it's in the system and it's the release date. They do it for movies too.
