Technically no. Sony Interactive Entertainment currently hold the license as per their deal with Marvel, so only they can make games about Spider-Man SPECIFICALLY. However, in games with an ensemble cast, a la the various mobile games and Ultimate Alliance 3, the character can still be used at Marvel's discretion.
Just not this SPECIFIC version of Spider-Man, which IS the property of PlayStation.
Marvel doesn't need Sony, most of Spidey's money comes from merch, and they wholesale own that.
The only bit of the Spider-Man IP Sony owns is film rights. Everything else? Marvel. Comics? Marvel. Merch? Marvel. Cartoons? Marvel. Video games? Marvel.

Shipped to stores doesn't translate to sell-through though. You could ship 30 million consoles to stores and yet if less than half of those sell, that's not a good thing for your brand.
Sell-through is arguably just as important, if not more so, to a company.

I went in hyped up and came out beyond underwhelmed.
That has nothing to do with the games and given the majority of Spider-Man's value lies in merchandising, which Marvel holds all rights to, and the success of the MCU before Spider-Man was even in the picture, they really don't "need" them at all.
They WANT to work with them, however.
But again... nada to do with the games.
