It really has to be a balanced affair, where there is mutual respect of each others rights and needs. That is why I don't think no DRM is the key either.
I know plenty of people that would abuse the no DRM to oblivion.
My Surface Pro has never needed a disc. I haven't used my desktop PC optical drive in ages, which is a DVD-ROM!
Everything is available on the internet, and everything is faster and more convenient than storing discs. Just download and GO!
I can only imagine the users of Netflix forcing the company to stick with DVD/Blu-Ray in favor of their focus on digital streaming.

I can whisper to my Xbox One and it can hear me. However, at night time, for some reason my room creates an echo, this seem to confuse the Kinect so I have to repeat myself.
Still better than looking for the controller, turn it on, make the choice, turn it off, and stove it away every single time!
As it stands, Xbox Fitness exceeded my expectations and I'm hoping for more content soon.
From a gaming perspective, Kinect Sports was fantastic, and the voice integration into Mass Effect 3 really added another dimension.

Remember how the Wii U hit 2 million during similar period, only to implode after the holidays. It is all about having the games to keep the platform going.
In a twist of irony, Nintendo proved with the 3DS that fortunes can be changed with drastic measures where at launch the 3DS was pretty bad, but a price cut and quality software essentially killed the high flying moment...
It is kind of sad that the Wii U hasn't picked up yet, but I'm guilty of not picking up a Wii U myself, even though I intended at launch. Nintendo didn't have stock at the time, and Xbox 360/PS3 kept me busy.

I haven't had a problem, and get HD on both Netflix and Amazon Instant Video. What is more telling is I go through a VPN, which slows it down considerably.

It sad, but the first mistake was working on a PS Vita title. That has so limited market, and to top it off they went with their own engine. No small company should ever create their own engine, if they can avoid it.
No small team will be able to beat the professional work a game engine developer.
Then there is the certification requirement (and this applies to all console makers) and they are a b!tch to get through, and as noted slow as hell!

I didn't do that the first time, and it was a little hit and miss. Once I calibrated it correctly, I am able to whisper to the Kinect.

Point being, MS is the only company creating a full fledged new OS for their Xbox One. It is stable as hell, and have we forgotten how Sony's PS3 used a whopping 120 MB of RAM, only to be reduced to 48MB years later. The point of DRM isn't to stop hardcore pirates, but the casual pirate because it is easy and accessible.
If you must fiddle with it, take risks on viruses/trojans or risk it crashing your computer, you might just want to pay for it.
