nowhere in here did I see it report that they are selling "refurbished" consoles as new.
they are selling new consoles with older hardware. I still think it's a stupid idea, as that hardware has a high failure rate, but what they are doing is not illegal.
it's no more illegal than me buying a brand new PC with a pentium 3 processor in it. it's old technology, but not illegal.
