The ESRB has no control over what games are allowed on the consoles. They only create ratings which aren't even enforceable. Stores voluntarily do age certification. It's not legally required.

Yes when they do ads like "Best Selling Console" and "Only 4k Console" and saying things like "canceling games is better for Xbox gamers". Or all the times they over-hyped things like SDK updates 5 Ghz over clocks ect.
