It won't affect Microsoft for sure. First of all they own MSN, which they can claim they based xbox live messaging, second they can claim the xbox 360 is a computer therefore not infriging on video game patent, third the xbox 360 was released before the wii therefore it wii has no bearing on the development of the xbox 360. Both the xbox 360 and ps3 were intially planned for 3.5Ghz but it was too hot so they went down to 3.2Ghz. Now the ps3 is rumored to get pushed down to 2.8Ghz because of excessive heat.

It would work how xbox live is currently working. So when you buy a game under your gamer tag you will own it forever. So if your get a new harddrive it already stated in your gamer profile that you bought the game so you can re-download it for free. There is no way your friend can play it because he would need your gamertag to play it.
