If something is described on the box and it doesn't come with what is described, yes it's the retailers responsibility because you are buying it from them. They shouldn't sell products which aren't as described on the box. Perhaps the law is different in your country but in the UK, that's how it works.

If a game box states free dlc on the back yet he doesn't have access to the free dlc because it's a used game, the retailer of said game used or new, is the one to blame for not clearly stating it doesn't contain the dlc. Game publishers are probably using this as a loop hole but ultimately in the uk at least, he should have been entitled to a refund and has every right to sue them for it.

Causing chaos? If it wasn't for n4g, I wouldn't have even known it was out. Went in my local gamestation yesterday plus watched a lot of tv over the last 7 days and not once noticed anything Kratos/GoW related.. extremely poor marketing by sony.
Why release a sp demo of an fps? Most people who will be buying MoH, will do so for the mp and probably play sp a few times. For those who don't care for mp but want to do sp, would be far better off just renting the game and saving themselves a lot of money.

Why so suprised? Japanese companies have a long history of shunting out their european fanbase.. nintendo are a prime example taking them over six months to release some games over here compared to our dudes from across the pond.
Halo reach will outsell any ps3 exclusive.. as much as I hate halo that's almost a given.. it's not that it's a better game or that the xbox is a better console, it's just microsoft are far better at marketing or at least invest more time in it to ensure highest possible sales. If this makes more profit though remains to be seen.
If this tries to be a tactical shooter and not just another popcorn one MOH *cough cough* then i'll be interested providing mp is decent and worthwhile.
