It's not so much as impossible, as so is it really worth it.
I just dislike things that some companies do, like Fruit Ninja Kinect for example that you mentioned. It's $1 on iPhone, but $10 on console.

I mean it's one thing for people to be inspired by other games(Minecraft->Terraria), it's another when you blatantly rip-off another and try to spin it around as if it isn't.(Minecraft->Fortr esscraft) >_>

The update was for class action lawsuits, not individual. If they did that, you are well in the ability to sue them.

They tried the pay to use service before, and those on PC had enough sense to basically tell them...NO.
If they FORCE that into the OS, and since the high point they're giving with it is that it's more compatible to gaming, you can be sure they're going to have the same results as when GFWL was temporarily pay-to-play early in it's life...

To be honest, i'm just tired of internet consumers thinking that gaming companies have to bend over backwards on what they do, and then turn around and backlash at that same company when they DO bend over backwards.
