Your patent has expired so you take nothing. Furthermore, methods of breathing were in public use more than one year before your priority date so your patent would be invalid.
First - there is no way to force all the prior distributed items to be recalled - that is what the damages will be based on.
Second - injunction is just to increase the settlement value.
Third - took a look at the patent - 5,640,152 - claim 1 is as follows:
1. A method for remotely controlling a function of a computer monitor or other equipment in response to transmissions from less than all of a plurality of transmitters remote from said equipment...
It is very possible that the competition in selling games for the unified platform would be enough - but hard to say.
Is deciding how to split the pie - because Sony and MS at a minimum would have to get together. Right now, both feel there are advantages in going it alone.
From a consumer and developer standpoint, it probably would be beneficial but I suspect we would see less of a price advantage for consoles (more like the Wii where you are paying $250 for $150 worth of tech).
The other issue is that no one really knows how to write code that works well on multi-core proce...
Fanboys are so funny - they attack things they know nothing about, make all kinds of stupid statements and constantly tear down anything that competes with the idol of their life. Don't get it personally.
Anyway - article was kinda lame. Suggesting Kingdom is something to look forward to is silly. There appear to be plenty of games for the XBOX 360 in a variety of categories to more than satisfy gamers of all types. But to promote titles that no one has played and everyone ...
The initial HD DVD transfers were far superior to the Bluray transfers (better codec, better images). And the HD DVD was cheaper, so I purchased a stand alone - hoping I could take advantage of the next year or two before the HD DVD format failed. Turns out that Bluray is going to be the official format sooner than I expected. So I care because I have a HD DVD player - but my XBOX 360 will never see a movie so that is irrelevant. I never, and I mean never, mix movies with consoles. The c...
If you are buying a Bluray player, up to now the PS3 was the best Bluray player and the cheapest so it made sense to buy, even if you didn't game. That has changed.
So now you are back in a situation where you had to decide based on games and price. The XBOX 360 is a lot cheaper if you want to game, the PS3 is a lot cheaper if you plan to game and want to use your PS3 to play blurays as well. I am assuming the games are basically equal - I suspect the big guns from Sony to...
To the stock analysis reports - I want to see how much money was made or lost by Sony's gaming division and Microsoft gaming divisions.
But I suspect MS is going to drop the price by about $50 USD in the next month or so - they were basically selling out during Christmas. I am curious if Sony can respond. But this is amazing - after a year and plenty of pitfalls, MS still has a huge lead on Sony. I don't see Sony catching up until at least the end of 2009 - if then. And pla...
I do not upgrade my PC to play games anymore but I will make an exception if I need to to play this game (assuming it is good). I am hoping for a Baldur's Gate-type experience where I end up staying up until 3-4 AM, getting in trouble with the wife for playing games and thinking it was worth every minute of pain from lack of sleep.
Hard to say how it will unfold but the list sound nice - but I don't really get the point being made that the list is so amazing. But then, some of big games (like FF or GT) don't appeal to me so maybe I don't represent the taste of the majority of gamers. And I don't get the excitement about Flower or LBP but to each his own. Still, after 2008 there will be no reason to suggest (assuming these games hit as they are supposed to and are good) that the PS3 doesn't have a great game line up. A...
I don't know how you cannot be excited about some of the games coming for the XBOX 360 - Ninja Gaiden 2, Brutal Legend, Alan Wake. These games sound and/or look sick. If you don't have a XBOX 360 (and don't plan to) that is fine, but to crap on these games simply means you aren't a gamer or you are an idiot/fanboy.
Shame - I would like to hear comments that actually bring something to the table and instead I get to read posting after posting of crap. Why don't you try to loo...
You cannot do 1080p over the current bandwidth - true - but you could do 1080i, which gets converted to 1080p okay. And who needs a collection if you can access 1000 movies anytime you want for $6 each time you want to watch something. Seriously, how many movies do you watch 5 times? There are few but the number is pretty low.
So I think digital downloads are going to catch on sooner then you think. But we will see.
I don't mind Bluray winning (thought it would happen because of the number of PS3 sold - that simply dwarfs the number of HD DVD players sold) but I had hoped Time Warner would hold out until after the HD DVD extended version of the LOTR trilogy was released - now it looks like I will have to wait until I get a $200 BR player to watch the extended version in HD - not going to buy the theatrical release - the extended version is much better.
Oh well, at $200 I could afford to take t...
Because everyone has to use the same controls.
Not so sure. PC gaming is more of a niche than a console - sales are way down - except for casual games and they don't even need a video card to play. The real issue for me is that PC developers have never tried to be efficient - they just write code assuming your PC will be a beast and if you cannot play it, you will be motivated to upgrade and spend $300 on a new GPU and more memory.
Before the introduction of the HDTV this would have been true - a console on a SDTV sucks...
LOL - that deserves a bubble!
One the one hand, the game play apparently has sweet parts that are fun and enjoyable. On the other hand, even fun enjoyable game play cannot overcome the fact that it is hard to do much with Mario that has not already been done. And the camera angles (sometimes a problem with Mario 64 as well as any other 3-D game platformer I have played) aren't perfect.
Still, I think this would be one of those most have games if I owned a Wii, except for the fact that I don't like the who...
is that there is very little difference. Both systems have strengths and weaknesses - PS3 can have more things on screen and make better physics calculations, the 360 can provide better textures and provide better AI (assuming both systems are used to their theoretical max). But the difference is only going to matter for certain games.
In the end, Sony is going to win because the Bluray format will ultimately prevail (I own a HD DVD so not a fan, just the number of bluray pla...
Mighty douche - I think you mean business "sense." And unless Sony or MS has paid a lot of money I would be surprises to see any title remain exclusive - it just doesn't make sense. Especially now that developers are starting to figure out the strengths of both systems and can (if they work at it) make a great game on both systems.
Sure, you lose a few dollars from the idiots that would say - I am not buying it because it isn't exclusive. But the gamers on the othe...
I know there is a large number of pirated games (and I don't condone the copyright violation). But you cannot steal a digital copy - the only question is what percentage of those pirated copies would become paying customers if they couldn't have obtained a free copy. I personally think the number of pirated copies doesn't come close to directly relating to the amount of sales lost - if it costs nothing you don't mind giving it a try - if it costs $50 you might pass.
But still...
