For the Wii U to win back traditional gamers, it needs developers to focus more on immersive 1P experiences and less on "party titles". Development costs are what stifle originality, not patents. When something comes along and sells millions of copies, everyone and their dog tries to copy, assuming it's a safe bet.
If more "hardcore" (read: BROKE-ASS) gamers would actually buy the fucking games instead of bitching about games costing $60 (really it should be closer to $100 when adjusted for inflation), developers might be keen on trying more new ideas.
