Unfortunately the article is not clear enough. Take-Two has every legal right to shutdown this project. It's not just a graphics mod, it's a fan-made remaster of the PS3/Xbox360 version ported to PC (emulator-based mod) with visual enhancements. Since the original game is not on PC, this is clearly an Intellectual Property copyright infringement.

Consoles need optimisation to keep the balance between framerate-pacing and graphical quality. On PC, you get what you get with your hardware and settings. Besides, consoles are the lowest common denominators compared to PC. Even a GTX 1050 is more capable than a base Xbox One and a PS4. Remember the GPU inside those 7-year consoles is comparable to an HD 7870 at best.
Developers are rarely happy about the lowest common denominators in every generation regardless of their sales. It limits their vision, creates problems, and requires compromises thus more effort, resources and time.
I know this is being pedantic, but there's literally not a single country-named Ubisoft studio. All the studios are named after the cities where they are located. So, India has two studios, Ubisoft Pune and Ubisoft Mumbai (this is the one responsible for the remake).
