Both yes and no. DICE is owned by EA, there full name is actually EA Digital Illusions Creative Entertainment AB (EA DICE). They are however working pretty much independently and can do almost as they please.

I have seen 1080p movies with an average bit rate of about 8 Mbps (H.264 encoded) with picture quality almost indistinguishable from the Blu-ray version.

If the buffer algorithm is any good the movie shouldn't start before enough is buffered for the movie to play back smoothly.
