They're filed all the time. If a company is seeking an injuction to stop sales, you know they're looking to settle. If you're gonna fight a multibillion giant like Sony though, you can expect a long drawn out battle, plenty of appeals if they lose and no injunction ever, or just a small sum settlement.
Whoever thinks this will in any way harm Blu-ray, Sony or PS3 are kidding themselves.

Silent Hill, Haze, PES, RE5? I don't believe for a second that any of these will be exclusive to PS3, or anything. Not because PS3 can't support them (good games in good genres sell, see: Resistance, Motorstorm), but because the companies behind them want to maximize profit and these are all multi titles.
Especially this one from Capcom. Wtf? The company that made DMC4 multiplatform is suddenly going exclusive? Nope.
This isn't some crappy rumour, it was already in development for PS3, and MS paid them and made them sign an NDA for it to be a timed exclusive for 360.

But from a casual point of view, the one that matters, Sony is still one of the, if not THE coolest brands. Manufacturing electronics is a big plus, and gives leverage to the video games aren't just for nerds strategy they began with PS1. Their constant sponsorships in a wide range of industries and huge success with the PS brand are big factors.

This game has always been multiplatform. Kinda like the other Silent Hill games. It'd be a huge shock for this to just be for PS3. But if it's up for debate by the developer, then it'll either be PS3 as a lead platform, PS3 as a timed exclusive or both. No way they're gonna have this exclusive, and Konami really has been wanting to put out their multi titles with PS3 as the lead and on the PS3 first, so it makes sense.

What we know is that it will be some kind of PS3 exclusive, timed or not, and PS3 will be the superior version.

I agree that exclusives will make a comeback. The costs won't be high forever and I would think at the most, an ordinary game could cost 45 million (over the top exaggeration) that game would have to sell 1 million to be successful, and with 10 million units out there, that'll be easy, especially since we assume the 45 million has gone into making the game good.
Except it sells 8k in Japan a week. 360 sells 8k a month.
You're not factoring in the fact that these are the slowest months of the year, the fact that MGS4 has NOT been delayed, the fact that Uncharted, Lair, Sigma, R&C5, Home, GT5Prologue, Heavenly Sword, LittleBigPlanet, Warhawk and the non exclusive GTA4, DMC4, Assassin's Creed etc are all coming out in the coming months, and nothing has really been released since MotorStorm.

People buying HD-DVD need to stop! Just accept Sony and Blu-ray like everyone else and think about others for a change instead of focusing hatred on Sony. Nobody wants a format war, and HD-DVD isn't even a format anymore, it's in its coffin, these posthumous purchases won't change a thing.
Yowza, this is pretty bad for something that's supposedly meant to top Gran Turismo. GT never got such low scores (low for comparative purposes - obviously 8-9 is still high) except from Gamespot...surprise surprise.
Even then it was only GT4, arguably the weakest link.
Damage is reported to not be as good, graphics aren't top of the line, may as well wait for GT Prologue this Fall or GT Concept 2007-2008 before GT5 comes in and sweeps up another 10 million gamers.
Funny, Gamecube had an issue with this, same with N64, but Dualshocks were just fine for the amount they had. Nintendo f***ed up and Nintendo had to fix it.
Also, its very common knowledge that in most cases, once something in a small market gets on a lot of mainstream magazines, its reached the peak of popularity, and will decline. (Apple & iPod made it but they were in the huge music market, not the smaller gaming market - in terms of numbers of people)
