Except Nintendo let you upload. You just can monetize when it's a game from Nintendo In-House team. Outside studio is excluded except for Pokemon in some cases.
Nintendo doesn't prevent anyone from uploading nor do they give copyright strikes for uploading gameplay unless you were able to receive a review copy and break the guideline in stating you can do certain things the embargo lift.
