That's not nitpicking to be clear and avoid misleading.
It's perfectly fine to show a current gen gameplay. That's no excuse to say it's on next gen too. Even of it's not cross gen, but real new gen, If anything, it will look very similar than PC too. Nobody would blame them for showing a PC gameplay too.
So all in all I don't think it's a valid point.

Why do people keep saying the games are next gen? They aren't. They are cross gen. In the same way people were saying Watch Dogs was next gen.

E3 changed a bit but more importantly Sony spent a few years experimenting with psx and proved the press gave more attention and better report on what was going on there.
