As far as I can tell, games that are being torrented as in stripped of it's DRM are still being downloaded. Clearly the lack of DRM doesn't stop piracy!

Let's face it, DRM worked damned well to prevent casual copying on current generation console.

Fact of the matter is the vast majority of games on PS3 used far less than the capacity and the data was just replicated to be read faster, because the blu-ray drive had insufficient read speed.
Not all dedicated servers are equal in the sense that location matters. This is where Azure shines and is combatting lag.
Fast stable connection to the dedicated server placed close to you. That is an f'in dream that most developers can't deliver.

Fact of the matter is, the digital vision MS has is far more flexible than the cumbersome system we have now.
As a digital consumer, you essentially have no rights for trade-in, resale, gifting or even barely sharing.

As the years go by, the consoles will build up a size able library. For everyone that library will be to big to play, to even care about new games.

Yes, on Xbox One you can have up to six people logged in. It automatically logs you in, because Kinect One recognizes you.
However, you can have infinite accounts on one Xbox One.
Each account is separate though, and there are no "sub" accounts.

However, by that time the consoles are likely entrenched and it's features way more apparent. That is where the Xbox One shines over the competition with dedicated servers in the cloud, instant switching, cable box integration and motion control with Kinect.
I think the tides are already turning and the sleepy giant is waking up.
The features of Xbox One, the games and now the cloud is drastically pulling MS ahead of the competition.

First of all, you are suffering from DRM currently. The DRM is on the disc. Steam has DRM, as you can't transfer your games to another person, and in many cases I can't even play my games offline at all.
Piracy doesn't affect the individual directly, but more as a group. If devs can't profit, they stop making games.
