I'm surprised that a lawyer would go after the disc scratches before the RROD. I mean, disc scratches for the most part, M$ isn't liable.
While the RROD is completely their fault, maybe for picking for manufacturers.
This just shows how little homework he did before filing this. He might have had a chance with the RROD. But obviously he's just trying to make a quick buck.

Yes I have the crappy drive. I have a crappy launch console. And yet mine has worked perfectly from day one. No RROD. Locked up once about 6 months ago.
You know the console doesnt scratch discs if you dont knock it when it's playing. I saw my friend do it to his. His 360 was on the carpet next to his TV, then he walked past his TV while playing Oblivion and his foot just knocked it a little while it was playing. What happened? Instantly we heard the scratching sound.

Yea once this game comes out a lot of people will buy it though. Naturally 360 will sell more, as it has the larger install base. I will be picking it up as soon as it drops, but I didn't pre-order it. I'm sure a lot of people are doing the same thing as me.
