The PS3 version held a higher framerate in 4 of the 6 clips but they said the 360 version maintained a higher framerate.

This is why the founders of Infinity Ward left the company. They created the CoD franchise but Activision has allowed the game to be crapped on and annualized.For them it's like: Get CoD out in time for holiday release,make 3 really expensive DLC map packs for the game,move on to the next CoD game, rinse and repeat.
A guess what, with Infinity Ward in disarray over losing it's founders don't expect this to be fixed, ever. The hackers know that Activision could care less about this game and that it'll never be patched so its pretty much free reign for them to do whatever they want to do.

That was part of the reason but Sony also knew that the PS3 had to find its identity as a gaming console and not a console/bluray player/pc.
It's DRM. Sony was one of the first companies to use it on their music CDs back in the day.
Come to think of it, the answer to this hack will likely be in the form of something like this. DRM contain rootkits which is basically the hack that gets installed if you try to pirate the software.

The reason it looks better on PS3 but runs better on 360 is because the PS3 version is running the latest version of Biowares UE. The updated engine gives the PS3 version a crisper look but the PS3 had always had trouble running the UE. There are a few screen tears here and there but I didn't feel like that would keep me from wanting this game any less. Because I really want this game.
