OnLive PLAYS the game remotely on their servers and just sends you the video of you playing. PS3 games are played locally on your PS3, not a PS3 server in a Sony data center.

A Silver membership can still take advantage of movies, downloadable games, demos. I fail to see how an Xbox Live subscription is required.

This is accurate. The TOU is a contract that must be agreed to. Valid contract initiation is a whole area of contract law, and he could easily slip by on that technicality.
If Sony can't show beyond a doubt he ever agreed to a TOU or TOS, he's off scott-free... from this civil suit.
