This is actually a bigger issue then you think. This is purely an HDCP issue. For anyone to use a capture card with the PS3, they have to use component connections and can not use HDMI. That won't be an option with PS4. So all the live streamers and Youtubers of the world will not be able to use the PS4 aside from the direct upload, which will not be good enough for them. The big deal is that companies are trying to make money off of their likeness. Their product is their image. Themselves. They have every right to be upset. If someone wanted to draw a picture of them and hang it on a wall, that is a compliment. Drawing the picture and mass producing it for sale is a different animal all together.
People don't make a big enough deal about HDCP. It's Hollywood's DRM and it is super restrictive. I have to deal with it through work constantly and everyone always gets mad at the wrong people when there are problems. The problem is everyone wants that single HDMI cable but no one understands the HDCP and handshaking that comes with it.

1080p on Xbox 360 via HDMI, 1080i via component on PS3. PS3 has that super hard HDCP for that intense copyright protection. With HDMI on the 360, I can't do stuff like Netflix because of HDCP, but everything else is good.
