If they release it on console the M/K can only be an option, which means they'll have to make the game in a way that you have to be able to play with a controller.

Yeah, and I don't like it. This isn't going to encourage developers to develop games native to the Vita. Didn't spend $300 on powerful graphics hardware to have it all take a back seat while the thing just streams graphics off another system that I'm not buying any time soon.
It just that I see way too many people putting too much emphasis on it, going as far as saying console exclusives are "playable on Vita" which is really supposed to be "playble WITH Vita." I might be really pessimistic in thinking this, but if people praise this feature so much companies are going to start thinking that this is all people want, that they can get away with just streaming their games to the Vita and be less encouraged to actually develop actual games for the...

While other studios rely on press release bullshots, this studio let the community do all the showing off. That says a lot.
The U.S. government wouldn't ban it. Either of two things will happen. Some very vocal people will cry about it, the publishers will get scared and not fund the game, or the publishers enjoy the negative attention, release it and will end up being played the cr4p out of.
Better watch out. They're trying to subtly introduce the idea of paid updates into our minds.
