Everything you said I agree with except the notion that they can't greatly improve the Wii U's situation. The PS3 got off to a similar poor start and turned it around.
You look around here and other forums and you see there seems to be lots of interest amongst people wanting to get on in on the Wii U now. NPD numbers show that Wii U sales are up 80% for April YOY.
Whichever way you cut it, a console that is 'dead', 'dying' or needs ...
I'm quite concerned about energy usage, and how much the bills cost for that matter, so what the the Wii U consumes here just makes the console even better.
From an internal design point of view as well, the Wii U is a masterpiece. If Nintendo can shrink the Wii U architecture into their next handheld, it will blow peoples' pants off.

Case will fall on its ass. Besides their patent being so vague, they'd have to sue Sony on the Move moreso, but Philips filed their patent in 2009, the Wii was released in 2006, so Nintendo owned any patents well before Philips.

The slow start of the Wii U will push Nintendo to make some of the best games ever seen in gaming history. Not only that, it will push Nintendo to create one hell of a console after the Wii U in 4 years time with their new R&D buildings in Paris and Kyoto.

Meaning, simplified, a game programed to work on the home or portable console, will also very easily be ported to the other.
