Well the thing about trademarking is that you have to show you have a reason for trademarking that name.
Normally if a random guy trademarks a name, and then a company wants to use that name, they would offer a small amount of cash for ownership, if the person refuses then the company can take him to court, if he can't prove that the name is being trademarked for a reason, then they can reassign ownership of the trademark.

Actually 'balance' isn't really much of an issue, there are not that many enemy types, and the only thing that differs with each power is the damage output, damage taken is the same with all unless you have a %10 less damage ability like the Concrete power.
This isn't a multiplayer game, so balancing is a lot easier.
Actually guys them saying that it is difficult to code the system is just an excuse. Japan already has the ability to change their PSN IDs.

They DID rush the game out. It is as simple as that. The game was unplayable in it's initial release state, DICE would have known about many of the bugs prior to the launch, but EA chose to release it on schedule to compete with COD.
