I'm most likely going to be getting both. 3DS strictly for Nintendo games and PSV for 3rd party and 1st part games. PSV will eventually overtake the 3DS though.

They don't own the IP but the own the publishing rights of Gears 1,2, and 3, So, any Gears of war game after that could come to the PS3 except gears 1,2,and 3.
