That is some good reading and it appears that it is mostly the stockholders taking action against the companies. Especially in section "II A. Canaries in the Coalmine?"
It appears that stockholders were taking action and the courts were preventing it at first. It has now swung the other way where shareholders are holding those in charge accountable.
