I like the xbox brand again because of Phil Spencer... when Don Mattrick was at the helm I honestly couldn't stand the brand anymore. I love Spencer, he's a quality guy and really turned the ship around.

The production value, story and attention to lore/detail combined with the better than assassins creed gameplay and nemesis system bump it up in to the solid 9 category for me.

I've been steeped in the "art world" since college as well, it's not some elitist thing that these mere peasants can never understand... I get your point... but like a lot of art it seems like some will just condone certain types of subject matter for shock value.
This type of philosophy is why certain types of movements, like the Dadaist movement for example, were/and still are... shit. Don't hate on my opinion... it's art.

I agree with you about freedom of speech and all that but where would you draw the line? What if there was a feature in the game that allowed the main character to graphically rape children?
Would this change your opinion of the game? If you disagree that this hypothetical feature should be in the game, by what measure of morality are you using to say that the devs shouldn't have that right as well under your original premise?
