Before hand the iPhone was only jailbroken, the DMCA wasn't clear on what constituted jailbreaking so they rectified that.
However with the PS3, this is not jailbreaking, part of the agreement with jailbreaking of games consoles is that any information obtained in relation to copyrighted information must be sercured by the person doing the jailbreaking.

In your post above this one, you stated about the DMCA, I shall point out though, the DMCA was broken on behalf of Geohot. According to the DMCA, jailbreaking a console and jailbreaking a phone are two different things.
So it isn't just "us" who argue the Apple v Geohot case is different to the Sony v Geohot case, it's the DMCA as well.
So I think you'll find you are the hypocrite in this case.
Some of the things I a disagree with, specifically on the PSN v Live aspect, the PSN Store is just as easy to use as the Live Market place, and I prefer the PSN Store because it feels more detatched, I just felt Xbox Dashboard and the Market place weren't well organised.

I think it's going to be immensly close between these two. A few articles are stating that people are looking towards getting an NGP as opposed to the 3DS, their deciding factor being on what other information is going to be announced.

Not really he was trying to correlate sales figures and make a point that fifth year of sales for one should count where as only the four year sales can count for the other.
