Sony will make official ones when they release their first limited edition console tied to a game. It will make those easier since all they will have to do is swap the plates for ones branded with the pack-in game. Forbidden West, GT7, GoW Ragnarok will probably all get one.

Vita launched at $249.99 and had an OLED screen in 2011. The Switch could and should have launched with one in 2017 and at the same price.
I think if they made their plates a different shape and used a different connector they could have gotten away with it but besides the pattern they are identical. That's definitely patent infringement.

You do realize in the 6 years between them tech changed, right? The cost to make them is likely close to identical at the time of their respective releases. Switch was built with left over phone parts.
