It seems like a good idea, it could mean every Xbox One game on the digital store can now be available on the Windows Store if they weren't previously. We're still years away from being able to play Switch games on ARM, especially since devices today won't possibly be able to play them even once the emulator is optimized enough since the nature of emulation is very taxing on CPUs.
This emulator is basically a given, it was going to happen eventually.
By that logic, the Xbox One and PS4 emulators should be playable by now, since they run on an x86 architecture, a common PC architecture. A lot of PCs are more powerful than both consoles, even at launch.

It should be illegal for games that are readily available officially such as PS4, Xbox One and Switch games. Games you cannot get anymore in an official capacity (which for me is going to a store to buy the game and part of that money goes to the publisher and developer) should be fine to download in my opinion, if Square Enix never does a re-release of Xenogears or Sega never does Jet Set Radio Future, then it should be fine or people can never experience those gems again.

That barely means anything, Nintendo has barely any say in the development of these games aside from what platform they appear on and the marketing. Nintendo wouldn't let Game Freak make games on other platforms and probably would have had them make a mainline Pokemon game in the launch year for the 3DS and Wii U (Wii U definitely needed something as big as a mainline HD Pokemon).
