Source has been continually updated, and was built that way. It might lack the technical prowess of a CryEngine, but Valve have never needed that, relying instead on outstanding art direction.

The problem with openGL, is that openGL has barely been touched since Half-Life 1 was released. Whereas DirectX has continually evolved into the standard.

Sony may be right here, but your whitewashing of user agreements does not hold any basis in reality. Shrinkwrap licenses often trample on your rights, something they can't actually do, and thus get rendered invalid.
