He didn't need a NDA in the first place. What he did was against the TOS. You agree to their terms when you buy their product.

Actually, he did break the terms of service. Since it was given to him before release, Microsoft classifies it as a beta console and any information leaked about it results in some action to be taken.

It's not only implied, sometimes it's directly stated in manuals that come with the product.

Actually you can stop people from leaking details if you don't want them leaked. Companies are allowed to do that.

At the end of AC2, Ezio let his main target live. He felt that killing him wouldn't bring back his brother or father.
There are also multiple times I remember Ezio waiting until the right time to kill some of his targets.
