I believe they tried to fix it, but they said they couldn't get to the core issue without rebuilding the engine,or something like that.Makes you wonder if they even tested it?.

But i guess when you're not used to playing on PC you wouldn't notice it so much.Some games (actually a lot of third-party games) on the PS3 have this issue as well especially concerning the screen tearing.Only Ghosts is really bad,it's unacceptable especially because it's fast paced FPS.
You must have had a special version,the game was playable but really annoying frame-drops.

I had a similar dispute with CoD Ghosts(PS4) when i wanted to trade it in and because of the UPDATE/PATCH reason they wouldn't take it back,same with TLoU Remastered where i asked that very question on ND's feedback page,when after a month they still didn't fix my issue and i explained this being one of those reasons why ppl join the # movement.They banned me from their page(forbidden)Me personally i'm done with this.

The problem with a refund is that you bought the right to use the game (license),when you read an EULA you'd see there's no warranty on software.That doesn't mean the publisher in question wouldn't offer a refund it's just not something you could enforce,unless of course you want to go to court and don't mind spending more money than you're actually trying to get back.
Uncharted 2 overall is a better game IMO.
The essence of something running more smooth is different than a game's game-play/story.If you could play TLoU on the PC with higher resolution than the PS4 version it would really matter to have that PC GPU,otherwise why buy the PS4 version when you already have the PS3 version?.
Not to mention that the PS4 version has more issues.
My PS4 just crashed,never happened before this update.
